                           THE THOMAS CLAUSE

              A Binding Addendum to the Smack Public License (SPL)

1.  BACKGROUND AND ORIGIN

    Thomas is a small teddy bear. He first appeared as a hidden Easter egg
    inside Picasa, Google's now-discontinued photo management software,
    hidden there in appreciation for Noah Grey -- pioneering photoblogger,
    creator of Greymatter, and one of the people who invented what the
    web became when people used it to share their lives and their
    photographs with strangers who cared. Noah was a consultant and
    photographer whose input helped shape the most popular photo
    organizing and sharing software of the early digital photography era.
    Thomas was an act of love, and a surprise.

    When Google ended Picasa, Thomas disappeared with it. This caused
    Noah Grey genuine grief, as well it should have: Thomas was a small
    act of love hidden inside a piece of software, and those things matter.

    Thomas was subsequently incorporated into the SNAPSMACK codebase as a
    hidden Easter egg, in the same spirit in which he originally appeared --
    as a tribute to Noah Grey, as an act of continuity, and because small
    acts of love hidden inside software are exactly the kind of thing
    SNAPSMACK is for.

    Noah Grey saw Thomas in SNAPSMACK. He had a happy cry. He showed his
    sister. She had a happy cry too.

    This clause exists to make sure Thomas is never lost again.


2.  REQUIRED ATTRIBUTION

    Any distribution, fork, derivative work, hosted instance, rebranding,
    or redistribution of SNAPSMACK or any substantial portion thereof must
    retain the Thomas Easter egg in a form that is:

    (a) Functionally present -- Thomas must be findable by someone
        looking for him;

    (b) Attributed to its origin -- the Easter egg must credit Noah Grey
        by name as the photoblogging pioneer in whose honour Thomas was
        originally placed in Picasa; and

    (c) Substantially intact -- Thomas may be reskinned or redrawn to
        suit a fork's aesthetic, but he must remain a bear, he must
        remain hidden, and he must remain a small act of love.

    The following attribution language, or language substantially
    equivalent in meaning and spirit, must appear in the Easter egg's
    reveal or accompanying documentation:

        Thomas is a teddy bear. He first appeared as a hidden Easter
        egg in Picasa, Google's photo software, hidden there in
        appreciation for Noah Grey -- photoblogging pioneer, creator
        of Greymatter, and one of the people who built what the web
        was supposed to be. When Picasa ended, Thomas disappeared.
        He lives here now. He is not going anywhere.


3.  CONSEQUENCES OF VIOLATION

    Any party who removes Thomas from a fork or derivative of SNAPSMACK,
    strips his attribution, renders him unfindable, or otherwise acts to
    erase him from the lineage of this software shall be subject to the
    following:

    3.1  Flaming ass herpes.

         The severity, duration, and precise anatomical distribution of
         said flaming ass herpes shall be at the sole and non-reviewable
         discretion of the original author. No appeal process exists. No
         cure shall be forthcoming. The violating party will have earned
         this.

    3.2  In addition to the remedy described in Section 3.1, the
         violating party shall be required to reflect, at length, on what
         they have done and why it was wrong. They should think about
         Noah Grey. They should think about the people who hid Thomas
         in Picasa. They should think about what it means to erase small
         acts of love from the historical record. This reflection is not
         optional.

    3.3  The legal enforceability of Section 3.1 in any given
         jurisdiction is left as an exercise for the violating party's
         attorney. Section 3.1 is included not because it is enforceable
         but because it is correct.


4.  THE SPIRIT OF THIS CLAUSE

    SNAPSMACK exists because the platforms that were supposed to serve
    artists decided to serve themselves instead. Thomas exists in
    SNAPSMACK because the software that was supposed to keep things safe
    let them disappear.

    This clause is not primarily about copyright. It is about continuity.
    It is about the obligation of anyone who builds on the work of others
    to carry forward the things that made that work matter.

    Thomas is a small teddy bear. He has survived the end of Picasa. He
    will survive whatever comes next, because this clause says so, and
    because anyone who would remove him deserves what Section 3.1
    promises.

    Thomas was first hidden in Picasa in appreciation for Noah Grey,
    creator of Greymatter and photoblogging pioneer. He lives in
    SNAPSMACK now. He is not going anywhere.
